The Demise of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension triggered by the presentation of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been defused. A Washington representative spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its response: another massive barrage of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the bleak nature of the current period. By day, negotiation efforts are waged: positive announcements are delivered from various governments. Considerable effort is expended on managing particular approaches. By night, Moscow brutally reminds the world that, for them, war remains the key method for achieving "resolution".

Nocturnal Warfare

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was laid bare. Ukraine is capable of detecting rocket firings from enemy soil, a ability enabled by up-to-date information. From witness perspectives, defense planes that had been deployed to intercept incoming aerial threats streaked across the sky – modern combat jets provided to Ukraine by Western partners.

Shortly after, Kyiv's missile defense activated: defensive missiles fired to intercept a Russian ballistic missile. This was a sophisticated defense system at work, most likely provided by Western nations. Every deployment creates sudden vibrations, causing tremors. The brief panic quickly becomes resigned acknowledgment: perhaps the approaching threat won't hit its mark this time, preventing destruction from ruin and additional electricity failures.

Persistent Threats

Following this, a large-caliber weapon fired at a drone close by, part of a rapid response unit – most likely allied-provided weaponry. Sadly, the projectiles didn't strike the enemy aircraft – it pressed on overhead toward its destination.

Intermittently, this continued until dawn. Kyiv faced the early updates: several casualties, devastation and heating outages in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still went about their day – experiencing conflict. But those full day demonstrated Ukraine's essential dependence on external assistance – a reliance that neighboring countries are demonstrably unable to substitute in the short term.

Failed Diplomacy

The comprehensive proposal from US administration generated strong feelings, controversy and profound anxiety – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new approach from American administration adheres to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, manages to fend off. They stabilise the situation but never actually achieve victory. This trend will, undoubtedly, endure.

Tactical Assessments

It is tempting to accuse particular leaders of consistently pushing Kremlin's demands. But that does not seem to be the complete picture. American leadership works based on a premise well known to experienced diplomats: you cannot secure via talks what you have been unable to protect through force. The American government presumes that it is unrealistic to compel Moscow to surrender the territory that it presently holds in Ukraine's south or east.

The issue is that while acknowledging this situation, Washington does little to prevent Kremlin actions, through diplomacy or military means, from believing that the situation will not evolve additionally in its benefit in the months ahead.

Divergent Views

Therefore, Moscow is certain that time is on his side – that Ukraine and its allies are approaching exhaustion. Their incentive to accept conditions that does not give them the greatest potential benefit is virtually nonexistent. There may be multiple initiatives to end hostilities, but they will continue as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Kyiv believes that Ukraine can still persist, gradually sacrificing people and territory but averting a entire defensive failure until conditions improve in its advantage.

Present Conditions

Objectively, there are no genuine requirements for a truce. Now, personal considerations are coming into play: political desires to negotiate peace and secure international recognition, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unacceptable, so that their priority does not move to internal issues. And although their task will now be much harder after recent developments, it remains very improbable that this will alter their fundamental strategy.

These opposing factors are guiding negotiations.

Conclusion and Outlook

It took a just a single week to terminate the 28 points of the current initiative. Assertive and inconsistent approach of the matter by Washington, opposition by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, current information leaks, all achieved their purpose.

While new plans based on established approaches are imminent, Kyiv, London and other Western governments should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and show specific hesitation to change the course of events, if they remain united and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the foreseeable future, primarily depend on sustained allied backing.
